Terms & Conditions

These Terms & Conditions (“Terms”) govern your company’s use of EchoTags’ NFC-based security patrol logging service (“Service”) and purchase of NFC tags (“Tags”). By ordering, you agree to these Terms.

1. Account & B2B Only

• The Service is provided exclusively to businesses (B2B). No consumer sales.
• You are responsible for the accuracy of company and billing details and for user access within your organization.

2. Pricing & Billing

• Subscription: €99 per location per year for service access.
• Tags: €2.50 per tag upon initial sign-up (one-time).
• Optional Protection Plan: €1 per location per month for automatic free replacements of damaged tags.
• All prices are excluding applicable VAT unless stated otherwise on the invoice.
• Invoices are due within 14 days unless otherwise agreed in writing.

3. Service Features

• Scan logging with timestamps and assigned locations, accessible in your company dashboard.
• Role-based access for your staff accounts (if configured).
• Service availability is targeted at 99% monthly uptime excluding planned maintenance.

4. Tags & Replacements

• Tags are assigned to locations you define. You must install them in appropriate, secure spots.
• We replace damaged Tags free of charge when you have an active Protection Plan for that location, or at our discretion if covered by standard warranty against manufacturing defects.
• Misuse, vandalism, or theft are not covered unless explicitly included in the Protection Plan.

5. No Refunds

All sales are final. No refunds are provided for subscriptions or Tags, except where required by law. Coverage for damaged Tags is provided via the Protection Plan described above.

6. Data Processing

For scan data, EchoTags acts as a processor under GDPR. The Data Processing Agreement (DPA) is incorporated by reference into these Terms and applies when we process personal data on your behalf.

7. Acceptable Use

• No unlawful, harmful, or deceptive activity.
• No attempting to bypass security or falsify scan events.
• You must ensure your users comply with these Terms.

8. Intellectual Property

All software, documentation, and branding are owned by EchoTags or its licensors. No rights are granted except as necessary to use the Service.

9. Liability

To the maximum extent permitted by law, EchoTags is not liable for indirect, incidental, special, or consequential damages. Our aggregate liability under these Terms will not exceed the amounts paid by you for the Service in the 12 months preceding the claim.

10. Suspension & Termination

• We may suspend the Service for non-payment, security risks, or violations of these Terms.
• You may terminate at the end of the current subscription period by written notice before renewal.

11. Governing Law

These Terms are governed by the laws of the Netherlands. Competent courts are those in the Netherlands.
